Choice of legal form

The choice of legal form will result in the type of business you plan to open. The most common legal entities in Spain: Empresario Individual o Autónomo, Sociedad de Responsabilidad Limitada and Sociedad Anónima.

  • The individual entrepreneur (Empresario Individual o Autónomo) is an individual who works on his own, he can hire employees and is fully responsible for profits and losses that activity. typical of the small craftsman or independent professional choice.
  • The limited liability company (Sociedad de Responsabilidad Limitada) however can also be formed by more individuals, it requires more bureaucracy and requires an initial capital of EUR 3,000, however, is only responsible for the company’s capital. Members must not engage their assets. Typical form chosen by small and medium-sized enterprises.
  • The corporation (Sociedad Anónima) is generally used by big business, it requires an initial capital of € 60,000 and involves numerous obligations. Normally it is publicly traded.

Registry Italians residing abroad (A.I.R.E.)

The Register of Italians residing abroad (A.I.R.E.) was established by Law 27 October 1988, n. 470 and contains the data of Italian citizens residing abroad for a period exceeding twelve months. It is managed by the municipalities on the basis of data and information from the consular representations abroad.

The all’A.I.R.E enrollment. is a right and duty of the citizen (Art. 6 Law 470/1988) and is a prerequisite for use of a number of services provided by the consular representations abroad, as well as execution of important rights, such as:

  • the opportunity to vote for political elections and referendum to match the country of residence, and for the election of Italian representatives to the European Parliament in polling stations set up by the diplomatic and consular network in the countries belonging all’U.E.;
  • the possibility of obtaining the issue or renewal of identity and travel documents and certifications;
  • the possibility of renewing a driver’s license (only in extra U.E countries);
